Your use of 1happylife is subject to the Terms of Use (which includes this Privacy Policy). The Terms of Use (including this Privacy Policy) or any part thereof may be revised from time to time through an updated posting, and therefore you should check the Terms of Use (including this Privacy Policy) periodically. Revisions are effective upon posting and your continued use of 1happylife following the posting of revisions to the Terms of Use (including this Privacy Policy) will indicate your acceptance of such revisions. As explained in the Terms of Use, if you are under the age of eighteen (18), references to "you", "your" and the like in this Privacy Policy refer to you and your parent. Children 13 and Under

The Children's Online Privacy Protection Act ("COPPA") governs information gathering online from or about children under the age of 13. Verifiable consent from a child's parent or guardian is required before collecting, using, or disclosing personal information from a child under the age of 13 ("child" or "children"). 1happylife requires verification of a child's parent or legal guardian ("Parent") prior to an account being created for a child (a "Child Member"). If parental verification is not complete or successful, the child's account will not be activated and the child will not have access to those areas of the site that require account membership.

What this Privacy Policy Covers

This Privacy Policy covers 1happylife's treatment of the personally identifiable information 1happylife collects on the 1happylife website. This policy also covers 1happylife's treatment of any personally identifiable information that 1happylife's business partners share with 1happylife.

This policy does not apply to the practices of companies that 1happylife does not own or control or to people that 1happylife does not employ or manage.

Information Collection

1happylife collects a wide variety of personally identifiable information from Members (including Child Members), including, but not necessarily limited to, your first name and last name, middle initial, email address, street address, username, password, date of birth, and phone number. Personally identifiable information is collected when you register for a 1happylife website account, when you use certain 1happylife website products or services, when you visit 1happylife website pages, and when you enter promotions.

If the user is a child we require the Parent to submit the user's personal information during the registration process after receiving Parental consent to collect such information. If payment is required for your level of use, at the time of registration, we collect payment information (e.g., credit card and billing address) from users over 18 years of age or from Parents of users under 18 years of age, but such information is handled and stored by a third-party payment processor, not 1happylife. Such third-party payment processor does not have a right to share your personally identifiable information.

1happylife also receives and records information on our server logs from your browser including your IP address, browser type, 1happylife cookie information, time spent on the website and the pages you requested. This information is collected on all users of 1happylife, whether or not they are Members. 1happylife collects this information for the following purposes: (1) to provide statistical analysis of web page traffic patterns; (2) to administer 1happylife; (3) to allow for auditing of our services by third parties; and (4) for marketing purposes (including potentially sharing your information with our third party partners to provide you with information about products and services they offer). We reserve the right to use a third party service to collect such anonymous visitor data on our network of sites and services. Currently, we do not use any third party services to collect anonymous visitor data on our network of sites and services. Should we elect to utilize a third party to collect such data, 1happylife will amend this Privacy Policy to specifically identify such third party.

Information Use

1happylife is a website designed to facilitate the management of your blended community's life through features which may include, but are not necessarily limited to, schedule management tools, file sharing capabilities for a wide variety of information (e.g. addresses, childcare provider information, doctor information, emergency contacts, immunization records), expense management tools and communication tools such as instant messaging. While the information within these classifications may be required for the use of specific services or features of the website, you are not required to use all of the services and features. Once you register with 1happylife and become a Member, you are not anonymous to us.

1happylife uses information that is collected about you (including children's information) to customize the content and features you see, to fulfill your requests for certain products and services, to provide electronic notification services for events in your calendar, to communicate with you and for billing purposes. We may also use personally identifiable information (including children's information) to help us improve the functionality and materials offered at 1happylife, as well as marketing and promotional purposes (e.g. we may ask users via a link to become fans of or to like us on a social network).

Information Sharing and Disclosure

Except as specifically stated herein, 1happylife will not share your personally identifiable information with third parties. We will never sell or rent your personally identifiable information to third-party marketing companies.

1happylife will send personally identifiable information about you to third parties when (1) we have to respond to subpoenas, court orders or legal process, (2) we find that your actions on our website violate the Terms of Use, (3) we have your consent to share the information, (4) we need to share your information to provide the product or service you have requested, or (5) we need to send the information to companies who work on behalf of 1happylife to provide a product or service to you. Unless we tell you differently, these companies do not have any right to use the identifiable information we provide to them beyond what is necessary or in conformance with your request.

In addition, If 1happylife becomes involved in a merger, acquisition or other form of sale of some or all of its assets, information may be shared. 1happylife will take commercially reasonable efforts to protect the confidentiality of any personal information involved in such transactions and provide notice after the personal information is transferred, as well as prior notice if the information is to become subject to a different privacy policy upon transfer. In the unlikely event of a bankruptcy, information may be transferred to a bankruptcy trustee or debtor in possession and then to a subsequent purchaser.

We retain personally identifying information collected from children for only as long as necessary to fulfill the purpose for which the information was collected and delete the information using reasonable measures to protect against its unauthorized access or use once it is no longer needed.

SPECIFIC PERSONS WITH ACCESS TO PERSONAL INFORMATION

As noted above, if payment is required for your level of use, we use a third-party payment processor to collect payment information from Members over 18 years of age and from Parents of Members under 18 years of age. The third party payment processor we presently use is 2checkout.com.

We share names, addresses, and last four of social security numbers, with a third-party company, Electronic Verification Systems, which assists us in Parental Verifications.

We also use IDL Web Host as our hosting provider.

Other than us, Electronic Verification Systems, and 2checkout.com, there are no entities or other persons collecting or maintaining personal information through 1happylife. Any inquiries from Parents regarding our information collection, sharing and disclosure practices may be directed to:

HOW WE NOTIFY AND OBTAIN CONSENT FROM PARENTS FOR THE COLLECTION OF INFORMATION ABOUT CHILDREN

We require a Parent Member to register all Members who are children. However, for children who are 13 or under (a "Child), during the registration process, we require the Member seeking to register the Child to affirm through our third party vendor Electronic Verification Systems' question process that such Member possesses legal parental or guardianship of the Child and that such Member consents to the Child's use of the website and registering as a Child Member. Parent Members further affirm that they have read and accepted the Terms of Use (including the Privacy Policy and Account Member Agreements), as well as that such Parent Member is fully able and competent to enter into the terms, conditions, obligations, affirmations, representations and warranties set forth in the Terms of Use (including the Privacy Policy and Account Member Agreements). If verification is not completed, absent misrepresentation, a Child cannot be registered for a Child Member account, and a Child's personal information cannot be collected.

HOW PARENTS CAN ACCESS, CHANGE OR DELETE PERSONALLY IDENTIFIABLE INFORMATION ABOUT THEIR CHILDREN

At any time Parents can refuse to permit us to collect personal information from their Children and can request that any personal information we have collected be deleted from our records. We use two methods to allow Parents to access, change, or delete the personally identifiable information we have collected from their Children:

  1. A parent can access, change or delete his or her Child's personal information by logging on to their Parent Member account and editing the Child Member account's information.
  2. A Parent can contact us to access, change or delete the personal information we have collected from his or her Child by sending an email to admin@1happylife.com. Please indicate the Child Member's user name and password and the Parent's email address used to register the Parent Member account in the e-mail so that we can better assist you with your inquiry or request.
PARENT PARTICIPATION IN CHILD'S USE OF 1HAPPYLIFE

We encourage Parents to spend time online with their Children and to participate in the activities that may be offered on 1happylife. No personally identifying information should be submitted to or posted on 1happylife by Children without the consent of their Parent. We encourage Parents to monitor their Children's online use, and to help us protect their privacy by instructing them never to provide personally identifying information on 1happylife or any other website without permission. We are also prohibited by law from conditioning a Child's participation in any activity on 1happylife on the Child disclosing more personally identifying information than is reasonably necessary to participate in such activity.

Parents should instruct their Children not to give their name, email address, home address, telephone number or any other personally identifying information that would enable someone to contact the Child either online or offline, without first asking the parent or guardian for permission.

We may disclose a Child's personally-identifying information in special cases when we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) our rights or property, other users, or anyone else that could be harmed by such activities. We may also disclose a Child's personally identifying information when we believe in good faith that the law requires it.

HOW WE NOTIFY PARENTS IF OUR PRIVACY POLICY CHANGES

We may amend our Privacy Policy at any time. We will provide Parents notice by email of any material changes in the way we intend to collect, use, and/or share Childrens' personal information. Parents should update their personal information to provide us current e-mail addresses. We will apply material changes to our Privacy Policy only in conformance with applicable law, including any COPPA provisions that require parent consent.

Cookies and Tracking Information

The 1happylife website may set and access 1happylife website cookies on your computer. The 1happylife website allows other companies that are presenting advertisements on some of our pages to set and access their cookies in your computer. Cookies are alphanumeric identifiers that we transfer to your computer's hard drive through your Web browser to enable our systems to recognize your browser and to provide customized features to you. The Help portion of the toolbar on most browsers will tell you how to prevent your browser from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether. Additionally, you can disable or delete similar data used by browser add-ons, such as Flash cookies, by changing the add-on's settings or visiting the website of its manufacturer. However, cookies allow you to take full advantage of 1happylife's best features, and we recommend that you leave them turned on.

Prior to your creating a Member account, we may employ cookie technology on the website to track non-personal information such as type of browser, operating system, domain names and IP addresses. Prior to your becoming a Member, we do not link IP addresses to any personally-identifiable information. However, once you register and affirmatively opt-in and provide personal information about yourself, such personal information provided by you or collected through the cookie technology may be used for marketing purposes back to you. If you do not want to receive e-mail or other marketing communications from us, please opt-out.

Please also note that we reserve the right to monitor your compliance with the Terms of Use and may track your usage of 1happylife in order to confirm compliance with the Terms of Use. Further, we also reserve the right, in our sole discretion, to terminate your access to 1happylife for any reason, including non-compliance with the Terms of Use or this Privacy Policy.

1happylife does not collect geo-location information from its users that is precise enough to identify the name of the street and city in which the user is accessing 1happylife.

Do Not Track (DNT) signals are signals sent through a browser informing us that you do not want to be tracked. We do not assign any meaning to DNT signals.

Your Ability to Edit and Delete Your Account Information and Preferences

1happylife gives you the ability to edit your Member account information and preferences at any time, including whether you want 1happylife to contact you about special promotions and new products.

LINKS TO OTHER SITES

1happylife may provide links to third party websites or resources. The information practices of those websites are not covered by this Privacy Policy or any other policies or terms applicable to 1happylife. We are not responsible for the privacy practices or the content of such websites or resources. We recommend that you review any terms of use and privacy policy of any linked third-party website or resource before providing any information to that website or resource or using its products and services.

Security

We have implemented technical, administrative and physical security measures that are designed to protect Member information from unauthorized access, use, disclosure or modification.

For example, your 1happylife website Account Information is password protected for your privacy and security. It is your responsibility to keep your password confidential and not disclose it to any other person. You are responsible for all persons using your username and password. Please advise us immediately if you believe your username and password have been compromised.

Further, because of the sensitivity of information stored on the 1happylife website, 1happylife uses SSL encryption to protect data transmissions.

From time to time, we review our security procedures to consider appropriate new technology and methods. Please be aware that, despite our efforts, no security measures are perfect or impenetrable. Neither people nor security systems are foolproof, including encryption systems. In addition, people can commit intentional crimes, make mistakes, or fail to follow policies. Therefore, while 1happylife uses commercially reasonable efforts to protect your information, we cannot guarantee its absolute security. If applicable law imposes any non-disclaimable duty to protect your information, you agree that intentional misconduct will be the standards used to measure 1happylife's compliance with this duty.

Data Storage

1happylife uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the website, including the use of IDL Web Host to host information you provide to us in cloud-based servers. The technical processing and transmission of 1happylife, including your content, may involve (a) transmissions over various networks, and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Currently, 1happylife and its authorized third-party vendors and hosting partners process data (including possibly your personal information) on servers in the United States of America and possibly in other countries. In some cases, personal information may be processed and stored outside your own country, including without limitation in the United States.

Disputes; Arbitration; Waiver of Class Action
Except as set forth below, ANY DISPUTE OR CLAIM ARISING UNDER THIS PRIVACY POLICY OR RELATING IN ANY WAY TO YOUR USE OF THE 1HAPPYLIFE WEBSITE WILL BE RESOLVED BY FINAL AND BINDING ARBITRATION, RATHER THAN IN COURT; provided, however, that the following are exceptions to our agreement to arbitrate our disputes:
  1. Any claim that qualifies as a small claim in a court of limited subject matter jurisdiction must be brought in such court; and
  2. Any claim for injunctive relief may be brought in a court of competent jurisdiction to enjoin intellectual property infringement or misuse.

You may begin an arbitration proceeding by following the American Arbitration Association's (AAA's) filing requirements and mailing a request for arbitration and description of your claim to InCorp Services, Inc. 2338 W. Royal Palm Rd., Ste. J Phoenix, AZ 85021. The AAA's Rules of Commercial Arbitration will apply (available at www.adr.org or by calling 1-800-778-7879). The arbitrator will have the power to rule on any challenge to its own jurisdiction or to the validity or enforceability of any portion of this agreement to arbitrate. Notwithstanding any of the foregoing, THE ARBITRATOR WILL NOT BE EMPOWERED AND DOES NOT HAVE THE AUTHORITY TO HEAR OR DECIDE ANY CLASS, CONSOLIDATED OR REPRESENTATIVE ACTION, TO AWARD PUNITIVE OR EXEMPLARY DAMAGES OR TO AWARD ATTORNEYS' FEES TO THE PREVAILING PARTY.

You may opt out of this agreement to arbitrate by providing written notice of your intention to do so to 1happylife within 60 days of the earlier of your first use of the website or your creation of a Member account. If you desire to opt out, please send written notice of your election to opt-out within the required time period to InCorp Services, Inc. 2338 W. Royal Palm Rd., Ste. J Phoenix, AZ 85021. Your written opt-out notice must be signed by you.

By using the 1happylife website, you agree that the Federal Arbitration Act, applicable federal law, and the laws of the state of Arizona, without regard to principles of conflict of laws, will govern this Privacy Policy and any dispute or claim of any sort that might arise between you and Interface. The prevailing party in any judicial action to enforce this arbitration agreement shall be entitled to a judgment that includes all fees and costs incurred in such action.
